MumsBerry cares about your privacy. We therefore only process data that we need for (improving) our services and we handle the information we have collected about you and your use of our services with care. We never make your data available to third parties for commercial purposes.

This privacy policy applies to the use of the website and the services provided by MumsBerry. The commencement date for the validity of these conditions is the 18th of June 2018, with the publication of a new version the validity of all previous versions is cancelled. This privacy policy describes what information about you is collected by us, what this data is used for and with whom and under what conditions this data could possibly be shared with third parties. We also explain to you how we store your data and how we protect your data against misuse and what rights you have with regard to the personal data you provide us.

About the data processing

 

Below you can read how we process your data, where we save it, what security techniques we use and for whom the data is accessible.

 

Online forms

On our website you will find a number of forms in which we ask you to enter personal data, such as your (company) name, address, e-mail address, web address and (mobile) phone number. We only use this information for the purpose for which you provided it. 

 

Transactional e-mails

If you place an order in our webshop, you will receive a number of e-mails concerning the status of your order. We send these e-mails via our webshop software PrestaShop. Our e-fulfilment partner (Webshop Service Nederland) will also receive your name, address, (mobile) telephone number and e-mail address to carry out the fulfilment work and keep you informed of the progress of the shipment. Webshop Service Nederland will then share your name, address, (mobile) telephone number and e-mail address with a carrier so that your order can be delivered.

 

Client management and invoicing 

Our customer data is stored in the CRM of our webshop software PrestaShop and then only used for administrative purposes.

 

E-mail

We use e-mail services from the servers of PrestaShop (transactional e-mails) and Metaregistrar (e-mailboxes of the company) and for the newsletters Mailchimp. All e-mail traffic is confidential and not accessible to the processor.

 

Web hosting and database

OVH: MumsBerry uses the services of OVH to host the website. This is a trusted service provider based in France. All data that you provide to us via our website is stored (temporarily or not) on OVH's servers. OVH has applied the necessary security techniques and it is forbidden for the processor and its employees or auxiliary persons - under the agreement between the processor and MumsBerry - to see data or make them available to third parties, unless they are obliged to do so on the basis of a statutory regulation. The processor periodically makes backups of the stored data. The same guarantees and conditions apply to these backups. Our webshop uses the security services of Let's Encrypt. We use their SSL certification.

 

Metaregistrar: We use the domain name registration services of Metaregistrar. Metaregistrar processes personal data on our behalf and does not use your data for its own purposes. However, this party can collect metadata about the use of the services. These are not personal data. Metaregistrar has taken appropriate technical and organizational measures to prevent loss and unauthorized use of your personal data. Metaregistrar is obliged to maintain secrecy on the basis of the agreement.

 

Webshop software PrestaShop: Our webshop has been developed with software from PrestaShop. Personal data that you make available to us for the benefit of our services will be shared with this party. PrestaShop has access to your data to provide us (technical) support, they will never use your data for any other purpose. The security measures that we take are the application of SSL encryption and a strong password policy. PrestaShop uses cookies to collect technical information regarding your use of the software, no personal data is collected and/or stored

 

Purpose of data processing

 

General purpose of processing

We only use your data for the benefit of our services. This means that the purpose of the processing is always directly related to the assignment you provide. We do not use your data for (targeted) marketing. If you share information with us and we use this information to contact you at a later time - other than at your request - we will ask explicitly for your approval. 

Your data will be shared with third parties in the following cases:

 

Mollie and Paypal: Our webshop uses the payment service providers Mollie and PayPal. We share your personal information with Mollie to process the transactions. In this context, Mollie reserves the right to share your data with third parties (financial institutions). Mollie is responsible for the protection of payment data in their possession and will keep all administrative, technical and physical measures from a commercial point of view, in a reasonable manner, to protect your personal data and payment data against unauthorized access or accidental loss or alteration.

 

Google Analytics and Ads: Through our website, cookies are placed from the American company Google, as part of the "Analytics" and "Ads" service. We use this service to track and get reports on how visitors use the website. This processor may be obliged to provide access to this data on the basis of applicable laws and regulations. We collect information about your browsing habits and share this information with Google. Google can interpret this information in conjunction with other datasets and thus track your movements on the internet. Google uses this information to provide, among other things, targeted advertisements (Ads) and other Google services and products.

 

Facebook Pixel: Through our website, cookies are placed from the American company Facebook. We use this service to be able to measure whether our Facebook and Instagram ads bring traffic to the website. This processor may be required to provide access to this data on the basis of applicable laws and regulations. We collect information about your surfing behaviour and share this information with Facebook. Facebook can interpret this information in connection with other datasets and thus monitor your movements on the internet. Facebook uses this information to offer targeted advertisements, among other things.

 

MailChimp: We send our e-mail newsletters with Mailchimp. Mailchimp will never use your name and e-mail address for its own purposes. At the bottom of every e-mail sent automatically via our website, you will see the 'unsubscribe' link. You will no longer receive our newsletter if you click this link. Your personal data is stored securely by Mailchimp. Mailchimp uses cookies and other internet technologies that make it clear whether e-mails are opened and read. Mailchimp reserves the right to use your data for the further improvement of the service and to share information with third parties.

 

Webstijl B.V.Our webshop uses the online marketing services of Webstijl B.V. Webstijl B.V. will process data solely in the context of carrying out marketing activities, website-related services for the development, management, promotion of our website, plus those purposes that are reasonably related thereto or that are determined with further consent. Webstijl B.V. processes your name, address, telephone number, e-mail address, IP address and the navigation and location software on your phone or computer. Webstijl B.V. has taken appropriate technical and organizational measures to protect your personal data. Webstijl B.V. reserves the right to use your data to further improve the service and to share (anonymized) data with third parties. All the above-mentioned safeguards with regard to the protection of your personal data also apply to the parts of Webstijl's services for which they engage third parties. Webstijl B.V. does not store your data for longer than legally allowed.

 

Tax and Service Solutions: We use the services of Tax & Service Solutions to keep track of our administration and accounting. We share your name, address and residential details and details regarding your order. This data is used for managing sales invoices. Your personal data is sent and stored securely. Tax & Service Solutions is obliged to observe secrecy and will treat your information confidentially. Tax & Service Solutions does not use your personal data for purposes other than those described above

 

Hotjar: We use Hotjar in order to analyse how our vistors navigate our website. This gives us insight into the mouse movements, click and scroll behavior. All data is made anonymous by Hotjar. Read Hotjar's privacy statement for more information about how they process the data.

 

Automatically collected data

Data that is automatically collected by our website is processed with the aim of further improving our services. This information (e.g. your IP address, web browser and operating system) is not personal data.

 

Cooperation for fiscal and criminal research

In some cases, MumsBerry may be obliged to share your information in connection with government tax or criminal investigations on the basis of a legal obligation. In such a case, we are forced to share your data, but will oppose it within the possibilities that the law offers us.

 

Storage time

We keep your data as long as you have an account with us. This means that we keep your customer profile until you indicate that you no longer wish to use our services or delete your account. If you indicate this to us, we will consider this as a request ‘to forget’ as well. We also keep the information about your purchase in order to answer any questions about the warranty or other questions or complaints about the product. 

 

Your rights

 

On the basis of applicable Dutch and European legislation, you have certain rights with regard to the personal data that is processed by or on behalf of us. We explain below which rights these are and how you can invoke these rights.

In principle, in order to prevent abuse, we will send summaries or copies of your data only to your already known e-mail address. In the event that you wish to receive the data at another e-mail address or for example by post, we will ask you to identify yourself. We keep records of completed requests, in the case of a request ‘to forget’ we administer anonymous data. You will receive all summaries and copies of data in the machine-readable data format that we use within our systems. 

You have the right to file a complaint with the Dutch Data Protection Authority at any time if you suspect that we are using your personal data in the wrong way.

 

Right to view data

You always have the right to inspect the data that we process or have related to your person or that can be traced back to you. You can submit a request to that effect to our privacy contact person. You will receive a response to your request within 30 days. If your request is accepted, we will send you a copy of all data with an overview of the processors who have this data, mentioning the category under which we have stored this data.

 

Right to rectification

You always have the right to have the data that we process or have processed which relate to your person, or that can be traced back to you, changed. You can submit a request to that effect to our privacy contact person. You will receive a response to your request within 30 days. If your request is granted, we will send you a confirmation that the details have been changed, to the e-mail address known to us.

 

Right to limitation of processing

You always have the right to limit the data that we process or have related to your person or that can be traced back to you. You can submit a request to that effect to our privacy contact person. You will receive a response to your request within 30 days. If your request is granted, we will send you confirmation - to the e-mail address known to us - that the data will no longer be processed until you cancel the restriction.

 

Right to transferability

You always have the right to have the data that we process or have processed that relate to your person or that can be traced back to you processed by another party. You can submit a request to that effect to our privacy contact person. You will receive a response to your request within 30 days. If your request is granted, we will send you summaries or copies of all information about you that we have processed or that has been processed by us, by other processors or third parties at the e-mail address known to us. In all probability, MumsBerry is no longer able to continue the service in such a case, because the secure linking of data files can no longer be guaranteed.

 

Rights of objection and other rights

In some cases, you have the right to object to the processing of your personal data by or on behalf of MumsBerry. If you object, we will immediately stop the data processing pending the settlement of your objection. If your objection is well-founded, we will make copies of data that we process or have processed available to you and then discontinue the processing permanently. 

You also have the right not to be subject to automated individual decision making or profiling. MumsBerry does not process your data in such a way that this right applies. However, if you are of the opinion that this is the case, please contact our contact person for privacy matters.
